The attached Appendix 3Y seeks to correct the information set out in an Appendix 3Y lodged by the Company on October 29 2008 (the “October 29 Appendix 3Y”). The October 29 Appendix 3Y referred to the director in question as holding a notifiable interest in 16,249,045 shares prior to his off market transfer of 3,000,000 shares to News Ltd on October 29 2008. In fact, on 29 October 2008 the director held a notifiable interest in 16,749,045 shares as the result of an increase in the notifiable interest of the director on 30 May 2007, with an acquisition of 500,000 shares by Meruma Pty Ltd. The reason that the Company has not previously disclosed the above increase and change in interest of the director which occurred on 30 May 2007 was a technological failure on the part of the office of the Company Secretary of the Company, which failed to receive an electronic notification of the acquisition which was sent to the Company Secretary by the office of the director on 4 June 2007. The discrepancy was in fact only identified as a result of the director’s off market transaction the subject of the October 29 Appendix 3Y.

The Company has arrangements in place with its directors under which the directors agree and undertake to provide the Company Secretary with details of any change to their notifiable interests. Further, as a result of the identification of this discrepancy, the director in question conducted thorough internal investigations as to its notifiable interests for the purposes of Listing Rule 3.19A, and confirmed to the Company on Monday 3 November 2008 that the shareholdings set out in the attached 3Y are accurate. The Company will review and restate its arrangements with each director. The Company will also implement confirmation processes between directors and the Company Secretary, to avoid any further miscommunications occurring in the future.
